Judge allows prosecutors to argue Lesly Palacio was killed during sex assault LAS VEGAS (KSNV) — A Clark County judge has allowed prosecutors to present a new argument in the murder of Lesly Palacio. Judge Tierra Jones on Monday granted a motion to amend the indictment against Erick Rangel-Ibarra following a brief hearing in the morning. Clark County Chief Deputy District Attorney John Giordani filed the motion in February. He wrote that prosecutors wanted to add an "alternative theory of first degree murder; to wit: felony murder (committed during the perpetration or attempted perpetration of a sexual assault)." The original indictment returned by a grand jury alleged that Rangel-Ibarra killed Palacio in a manner that was "willful, deliberate and premeditated." Nevada law requires prosecutors to give adequate notice for theories of prosecution, meaning the indictment must be updated.
