Stare Decisis
STAH-ray dih-SY-sis
Latin: 'to stand by things decided.' The principle that courts follow precedent established by earlier decisions of the same or higher court.
Plain-English definition
Stare decisis is the doctrine that courts should generally follow their own prior decisions and those of higher courts in the same jurisdiction. It promotes stability and predictability in the law. Vertical stare decisis (lower courts must follow higher courts) is mandatory; horizontal stare decisis (a court following its own prior decisions) carries strong but not absolute weight.
